Welcome to TM-Educ, the educational division of TICMEGA S.A. By accessing and using our platform, you accept these Terms and Conditions in full. We recommend that you read this document carefully, as it sets out your rights and obligations when using our services.

1. Definitions

  • "TM-Educ", "we", "our": Refers to TM-Educ, the educational division of TICMEGA S.A.
  • "Platform": Refers to the website, applications, and services offered by TM-Educ.
  • "User", "you", "your": Any person who accesses or uses the TM-Educ platform.
  • "Content": Includes courses, lessons, text, graphics, images, videos, and any other material available on the platform.
  • "Instructor": A professional who creates and/or delivers courses on our platform.

2. Terms of Use

2.1 Age Requirements

To use our services, you must be at least 18 years of age, or have the consent and supervision of a parent or legal guardian if you are a minor.

2.2 Account Registration

To access certain services, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your password and for all activities carried out under your account. You must notify us immediately of any unauthorized use of your account.

2.3 User Conduct

When using our platform, you agree to:

  • Not violate applicable laws or regulations.
  • Not infringe intellectual property rights.
  • Not share offensive, defamatory, obscene, or inappropriate content.
  • Not attempt to access our systems or networks without authorization.
  • Not interfere with the operation of the platform or servers.
  • Not create fake accounts or impersonate others.
  • Not share your login credentials with third parties.

3. Intellectual Property

3.1 Our Rights

All content on the platform, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, and software, is the property of TM-Educ, its content providers, or licensors, and is protected by intellectual property laws.

3.2 Limited License

We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use our platform and its content solely for your personal, non-commercial, and educational use.

3.3 Restrictions

You may not:

  • Modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information or content obtained from our platform.
  • Download courses or materials except when a download link is explicitly provided.
  • Use reverse engineering techniques or decompile any part of the platform.
  • Remove copyright notices, trademarks, or other proprietary notices from any content.

4. Courses and Payments

4.1 Course Enrollment

When you enroll in a course, you gain access to its content for the period specified in the course description or until otherwise indicated.

4.2 Pricing and Payments

Course prices are displayed in US dollars (USD) and include applicable taxes where required, unless otherwise stated. We accept the payment methods specified on our platform at the time of purchase. Payment must be made in advance to access courses.

4.3 Refund Policy

You may request a refund within 7 days of the purchase date, provided you have not completed more than 30% of the course. Refund requests will be evaluated on a case-by-case basis and must be sent to info@tmeduc.cl.

4.4 Certificates

Some courses offer completion certificates. To obtain a certificate, you must complete all requirements specified for the course. Certificates are personal and non-transferable and can be verified on our platform.

5. Responsibilities and Warranties

5.1 Service Availability

While we strive to keep the platform continuously available, we cannot guarantee that the platform will be available at all times. We reserve the right to perform maintenance or updates that may temporarily interrupt the service.

5.2 Content Quality

We strive to offer high-quality educational content, but we do not guarantee that the content will meet your specific needs or expectations. Content is provided "as is" and "as available."

5.3 Limitation of Liability

To the maximum extent permitted by law, TM-Educ shall not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of, or inability to access or use, the platform.
  • Any conduct or content of third parties on the platform.
  • Unauthorized access, use, or alteration of your transmissions or content.

6. Modifications and Termination

6.1 Changes to the Terms

We reserve the right to modify these Terms and Conditions at any time. Changes will take effect immediately upon publication on the platform. It is your responsibility to review these Terms periodically. Continued use of the platform after changes constitutes your acceptance of the new terms.

6.2 Termination

We may, at our sole discretion, suspend or terminate your access to the platform for breach of these Terms or for any other reason, without prior notice or liability. You may also end your relationship with us at any time by ceasing to use the platform and deleting your account.

7. General Provisions

7.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Chile, without regard to its conflict of law provisions.

7.2 Dispute Resolution

Any dispute arising in connection with these Terms shall be resolved through amicable negotiation. If no solution is reached, the dispute shall be submitted to the exclusive jurisdiction of the courts of Santiago, Chile.

7.3 Severability

If any provision of these Terms is deemed invalid or unenforceable, such provision shall be interpreted in a manner consistent with applicable law, and the remaining provisions shall remain in full force and effect.
